Scotland is tightening the planning framework around large-scale data center development as demand for AI infrastructure pushes projects toward unprecedented power requirements. The Scottish Government said on Sept. 16 that new data center applications exceeding 50 megawatts of power capacity must include an Environmental Impact Assessment during the planning process. The requirement creates a mandatory environmental review for projects above the threshold rather than leaving the need for an assessment to the usual screening process alone.

It also builds on a planning direction issued in August that requires local planning authorities to notify Scottish ministers about qualifying data center applications within seven days of validation. The combined measures give the Scottish Government earlier visibility into a development pipeline that increasingly intersects with electricity infrastructure, land use, environmental constraints and local planning decisions. For developers, the change means environmental analysis now becomes a central part of the development case for large projects from the beginning rather than a separate consideration later in the approval process.

The 50MW Threshold Creates a New Planning Baseline

The new direction applies specifically to data centers with a proposed power capacity exceeding 50 MW, establishing a clear dividing line for mandatory EIA submission under the new planning instruction. Scottish Government guidance defines power capacity as the total proposed electrical power available to a data center, typically expressed in megawatts. Projects below that threshold do not automatically escape environmental scrutiny, however, because existing EIA regulations continue to apply where developments fall within their scope.

The government said applications outside the direction’s 50MW threshold will still be assessed under established regulations, with the need for an EIA determined case by case according to legislative criteria and the circumstances of the development. That distinction matters for developers because the new policy does not replace Scotland’s broader environmental assessment regime; it establishes a mandatory route for a defined class of high-capacity data center proposals. In practical terms, the threshold turns electrical scale into an explicit planning trigger while preserving existing mechanisms for projects that could create significant environmental effects at lower capacities.

Environmental Assessment Moves Closer to Project Design

An EIA systematically assesses the likely significant environmental effects associated with a proposed development before planning decisions occur. Scottish Government guidance says the process considers whether a development is likely to create significant effects and provides a framework for understanding those impacts before a project proceeds. For a large data center, that assessment can bring together issues that otherwise sit across different parts of the planning and infrastructure process, including land requirements, biodiversity, soils, water resources, noise and emissions associated with backup generation.

The Scottish Government’s chief planner, Dr. Fiona Simpson, has highlighted the potential for large data centers to create a “significant industrial presence into the landscape” and identified possible effects on “biodiversity, soils, water resources, noise, and potentially for air quality where back-up generators are used”. Those considerations become more consequential as AI facilities increase power density and developers pursue larger campuses capable of supporting high-performance computing workloads. Consequently, the environmental review is becoming part of the infrastructure equation rather than simply an administrative requirement attached to a planning application.

Developers Now Face Greater Scrutiny Before Approval

The Scottish Government framed the policy as an effort to create consistency across applications while ensuring environmental effects receive consideration at an early stage. Public Finance Minister Hannah Mary Goodlad said: “The Scottish Government recognizes that data centers are a rapidly evolving sector attracting a broad range of views, opinions and concerns, and that evidence on the environmental impact of data centers continues to develop.” She added: “As this is an emerging industry, we have the opportunity to get this right from the start.

The guidance issued today is the next step in that process.” Goodlad also said: “We must balance the economic and employment interests in developing data centers with national energy, climate and community wealth building ambitions, which are vital to our future prosperity, as well as the potential impact on local communities.” Her comments place the environmental requirement within a broader policy framework that weighs data center investment against energy demand, climate objectives and community interests. The approach therefore signals that Scotland intends to evaluate large computing infrastructure not only as a source of investment and digital capacity but also as a major physical development with wider infrastructure consequences.

Planning Oversight Has Already Expanded

The EIA requirement follows a separate August direction that brought large data center applications into a more closely monitored planning process. Under that measure, local planning authorities must notify Scottish ministers within seven days after validating an application for a data center exceeding 50 MW. The Scottish Government said the notification system would support strategic monitoring of applications entering and moving through the planning system while allowing ministers to consider their wider infrastructure implications.

The August direction applies both to new planning applications and qualifying applications already under consideration when the measure came into force on Aug. 17. That means the September EIA direction is not an isolated intervention but another layer in a developing oversight framework for high-capacity computing facilities. Together, the measures give national authorities a clearer role in tracking projects whose electricity requirements can materially interact with Scotland’s wider energy and infrastructure planning.

Scotland Links Environmental Review with Economic Development

Goodlad has emphasized that Scotland does not view data centers solely through an environmental lens, pointing to their potential economic and employment contribution alongside national energy and climate priorities. She said: “Ensuring that an Environmental Impact Assessment is always part of the application process will create a level playing field for developers and will ensure potentially significant environmental effects are considered from the outset.” The government frames the requirement as a common standard rather than a project-specific hurdle, which could reduce differences in how local authorities handle large proposals.

The standardized requirement establishes that applications for data centers exceeding 50 MW must include an EIA as part of the planning process. At the same time, the requirement places more responsibility on project teams to understand environmental constraints before finalizing major design and investment decisions. Earlier consideration of environmental factors can help minimize the risk of delay at later stages and support a smoother passage of qualifying proposals through the planning process.

The Political Debate is Moving Alongside Planning Reform

The new planning direction arrives as the Scottish Greens push for a separate debate over AI data center expansion. Scottish Green MSP Patrick Harvie criticized the scale of the proposals and said: “Scotland is being hit by a huge surge of hyperscale AI data center proposals, and the Scottish Government is standing by while councils are being left to deal with the consequences.” Harvie also warned about the potential electricity demand, saying: “The scale of what is being proposed is extraordinary. If the first 24 of these projects are approved, they will require one and a half times Scotland’s entire peak electricity consumption. It is completely unsustainable.”

Those remarks represent the Scottish Greens’ position on the scale of proposed development and the associated electricity requirements, rather than an assessment adopted by the Scottish Government in its planning direction. The Scottish Greens have called for a moratorium on new hyperscale data centers, while the Scottish Government’s September direction establishes mandatory EIA requirements for new data centers exceeding 50 MW. The debate underscores how data center planning has moved beyond individual developments toward questions about Scotland’s electricity system, environmental capacity and national infrastructure strategy.

The Next Phase Will Test Project Economics

For developers, the immediate consequence is a higher bar for preparing large data center proposals before they enter the planning system. Projects above 50 MW must now incorporate an EIA into their applications, while qualifying applications must also move through the national notification framework introduced in August. The Scottish Government also said the Scottish Science Advisory Council, Scotland’s highest-level science advisory body, helped develop the new direction. That involvement points toward a policy approach that treats data center expansion as a rapidly evolving infrastructure issue requiring evidence across environmental, technical and economic dimensions.

The commercial effect will depend on how individual assessments identify significant impacts, what mitigation developers propose and how local and national planning authorities respond to those findings. Scotland’s data center market is therefore entering a phase in which securing power and land may no longer be sufficient; developers will also need to demonstrate that their projects can operate within the environmental and infrastructure limits of the locations they select.
